Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the CastAlert mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Tombstone Dash, LLC ("Company", "we", "us", or "our").

2. Description of Service

CastAlert is a mobile application that aggregates and delivers casting call notifications from various sources, including but not limited to Alessi Harteis Casting and other casting platforms. The App provides:

• Real-time push notifications for new casting opportunities
• Filtering options based on location and preferences
• Offline access to saved casting calls
• Links to original casting sources

3. User Eligibility

You must be at least 13 years old to use CastAlert. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To use certain features of the App, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

5. Use of Service

Permitted Use

You may use CastAlert for your personal, non-commercial use to receive casting call notifications and information about acting opportunities.

Prohibited Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Scrape, reproduce, or redistribute content from the App
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems
• Use automated systems or software to extract data
• Impersonate any person or entity
• Sell, resell, or commercially exploit the App
• Violate any applicable laws or regulations

6. Third-Party Content

CastAlert aggregates casting information from third-party sources. We do not control, endorse, or assume responsibility for:

• The accuracy, completeness, or legitimacy of casting calls
• Third-party casting platforms or their practices
• Outcomes from applying to casting calls
• Content, policies, or practices of third-party websites

Users should independently verify all casting opportunities and exercise caution when sharing personal information with third parties.

7. Intellectual Property

All content, features, and functionality of CastAlert, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Tombstone Dash, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE SERVICE
• RESULTS FROM USE OF THE APP

We do not guarantee that you will receive any particular casting calls, auditions, or acting opportunities through use of the App.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMBSTONE DASH, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Lost profits or revenues
• Missed casting opportunities
• Loss of data or information
• Business interruption

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tombstone Dash, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the App or violation of these Terms.

11. Subscription and Fees

CastAlert may offer free and paid subscription tiers. By subscribing to a paid tier:

• You authorize us to charge the payment method on file
• Subscriptions auto-renew unless cancelled before the renewal date
• You may cancel anytime through the App Store or Google Play Store
• No refunds for partial subscription periods

12. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the App will immediately cease.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts of San Diego County, California.

16. Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiations. If resolution cannot be reached within 30 days, the dispute shall be submitted to binding arbitration in San Diego, California, under the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tombstone Dash, LLC regarding the use of CastAlert.
